Is it legal to speed to pass another driver in Ohio?

We’ve all been there — stuck behind someone driving slower than we’d like, especially when we’re late. The temptation to press the gas and zip past is real. But is it legal in Ohio to speed just to pass?

The short answer: no. Ohio law doesn’t allow speeding for any reason, even to overtake a slower vehicle. If the posted speed limit is 55 mph, that’s your limit — whether you’re passing or not.

Typical Ohio speed limits include:

  • 20 mph in school zones

  • 25 mph in business and residential areas

  • 50 mph on controlled-access highways in cities

  • 55 mph on highways outside city limits

  • 60 mph on two-lane state routes

When passing, you must signal, move to the left at a safe distance, and not return to the right lane until you’re clear. Violating these rules can lead to an improper passing citation — a misdemeanor carrying at least a $150 fine and 30 hours of community service.

So, if you want to get around someone legally in Ohio, you’ll have to do it within the speed limit. It might take a little longer, but it’s the law.
